2. Scope
These terms apply to every purchase made in the Bistero shop through this website and to the use of the website itself. By confirming an order the customer states that they have read and accepted these terms. The terms are available on this page at all times and can be saved or printed.
Customers must be at least 18 years old and have legal capacity. This site is not intended for children and we do not knowingly collect data from minors.
3. Formation of the contract
The display of a product on this site is an invitation to make an offer. The contract is concluded when:
- the customer completes the checkout and confirms it using the button that states the obligation to pay,
- the payment is successfully authorised by the payment processor, and
- the seller sends an order confirmation to the customer's email address.
The seller reserves the right to decline an order, with a full refund, if the product is out of stock, if there is reasonable suspicion of misuse, or if the delivery address is not in the list of countries we ship to. We inform the customer of any such decision by email.
4. Prices and payment
- The bracelet costs EUR 25.00 (€) per piece and the price is the same for all three colours. All prices on this site are shown in euros and charged in euros.
- VAT is included in the price. A VAT rate of 25% applies to deliveries to Croatia.
- If your card is not denominated in euros, your bank may apply its own exchange rate and a conversion fee. That cost is set by your bank, not by the seller.
- Shipping costs are calculated separately and shown in the summary before the order is confirmed.
- The total amount to be charged is shown clearly before the customer confirms the payment.
- Payment is possible by card (Visa, Mastercard, Maestro), with Google Pay or Apple Pay through the processor Stripe, or with PayPal (PayPal balance or a card linked to it). The customer chooses the payment method in the checkout.
- The seller charges no fee for either payment method and the price is the same in both cases.
- The charge is a single one, made immediately upon confirmation. There is no subscription, no recurring charge and no automatic renewal; neither card details nor a PayPal billing agreement are stored for future charges.
- Goods are dispatched from a warehouse inside the European Union, so no import VAT, customs duty or clearance fee arises for the customer on delivery.
If a price changes after an order has been confirmed, the price shown at the moment of confirmation applies to that order.
5. Delivery
Delivery times and costs are stated on the shipping and delivery page and form an integral part of these terms. The risk of accidental loss or damage passes to the customer at the moment the customer, or a person nominated by them, takes delivery of the parcel.
Packing and dispatch are carried out by a partner warehouse in the European Union engaged by the seller. The seller remains the customer's sole contractual partner and is responsible for proper delivery, for the conformity of the goods and for refunds — all claims are addressed to the seller, not to the warehouse or the carrier.
If an order contains several items, they may be delivered in separate parcels. Shipping is charged once per order.
6. Product description and express limitation of claims
The seller offers an elastic bracelet with glass beads carrying the evil eye motif and a hamsa charm, in blue, red or black. The materials, measurements and packaging contents are listed on the home page. The seller warrants:
- that the bracelet delivered is new and unused,
- that it matches the colour chosen and the materials and measurements stated on the site,
- that the hamsa charm is attached to the bracelet and that a gift pouch is included in the packaging.
The seller expressly does not claim or warrant that the product has any effect on health, luck, financial situation, personal relationships or any other outcome. The product is sold solely as a decorative item. It is not a medical device within the meaning of medical device regulations, it is not a medicine, and it is not a substitute for medical, psychological, legal or financial help. The symbolism described on the site is presented as information about cultural heritage, not as a property of the product.
The beads are glass and strung by hand, so variations in shade, in the position of the motif and in size of up to 1 cm are possible. Such variations are not considered a defect.
7. Withdrawal and refunds
The customer has the right to withdraw from the contract within 30 days of receiving the parcel, without giving any reason. The procedure, the deadlines and the withdrawal form are set out in our returns and complaints policy, which forms an integral part of these terms. This is a voluntary extension of the statutory 14-day period and does not limit any statutory consumer right.
The seller waives the right to make a refund conditional on the return of the goods. The customer keeps the delivered goods and the seller refunds the full amount paid, including the shipping cost. This is more favourable than the statutory minimum and applies to every order.
Cancelling before dispatch. You can cancel an order at no cost as long as the parcel has not been handed to the carrier — send us a message with your order number and we refund the full amount within 5 business days. Once the parcel has been handed over, the withdrawal procedure described above applies.
No subscription. Every order is a one-off purchase. We do not store card details for future charges, there is no automatic renewal, and there is no cancellation fee because there is nothing to cancel — there is no recurring charge.
Refunds go back by the original payment method. If the payment was made by card, Google Pay or Apple Pay, the amount is refunded to the card that was charged; if it was made with PayPal, it is refunded to the same PayPal account. The seller charges no fee for processing a refund.
8. Liability
The seller is liable for defects in the goods delivered in accordance with the consumer law applicable in the customer's country of residence in the European Union. The seller is not liable for:
- damage caused by improper use of the product or use other than as intended,
- an allergic reaction to a material that is clearly stated for the item,
- delays caused by force majeure, strikes or severe weather,
- temporary unavailability of the website due to maintenance or technical faults.
This product is not a toy and contains small parts — keep it out of reach of children under three and never put it around a child's neck unsupervised.
9. Use of the website
All content on this site (text, design, logo, illustrations) is protected by the seller's copyright and may not be reproduced for commercial purposes without written consent. Using the site in a way that interferes with its operation is prohibited, including automated data collection and attempts to gain unauthorised access.
10. Changes to these terms
The seller may amend these terms. For contracts already concluded, the version of the terms in force at the time of the order always applies. The date of the last change is stated at the bottom of this page.
11. Governing law and dispute resolution
The seller is a company incorporated in the state of Wyoming, United States. These terms are governed by the law of the state of Wyoming and the federal law of the United States, without regard to conflict-of-law rules.
Consumer protection in the European Union. If the customer is a consumer habitually resident in a Member State of the European Union, the choice of law above does not deprive that customer of the protection given by the mandatory consumer protection rules of their country of residence, which implement Directive 2011/83/EU on consumer rights. The customer retains the right to bring proceedings before the courts of their place of residence.
We aim to settle disputes by agreement — please contact us first at contact@bistero.com and we will reply within one business day. If no agreement is reached, the courts of Sheridan County, Wyoming, United States have jurisdiction, except where mandatory rules of the customer's country provide otherwise.
Written complaints. A consumer may submit a written complaint by email to contact@bistero.com or by post to the seller's address in section 1. We confirm receipt without delay and provide a written reply within 15 days of receiving it at the latest.
Out-of-court dispute resolution. Consumers in the European Union may also try to settle a dispute out of court through the alternative dispute resolution body competent in their country. The procedure is usually free or very inexpensive for the consumer, and the seller takes part in it voluntarily and in good faith. A complaint may also be submitted to the competent consumer protection authority.
Before you start a chargeback with your bank. If you are unhappy with your order, please contact us first — in most cases we settle it the same day with a refund or a replacement. The option of disputing the transaction with your bank always remains available to you and nothing here asks you to waive it.
